EXAMPLE:
Rob is a medical marijuana patient with a valid California doctor's recommendation for marijuana use.  After work one evening, Rob and a friend are driving through North Hollywood, smoking a marijuana blunt in the car with the windows partially rolled down.  Driving down Magnolia, they spot an LAPD officer in their direction of traffic and Rob quickly pulls over to avoid driving past the police cruiser.  Rob and his friend both exit the vehicle and begin to walk towards a nearby convenience store.

The LAPD officer pulls over and drives up to the two men, exiting his vehicle and ordering them to stop.  The officer tells Rob and his friend that he could smell the marijuana smoke, and asked which of them had been driving the vehicle.  Rob admits to driving, and tells the officer that he is a medical marijuana patient.  His friend and passanger also has a valid doctor's recommendation.

Next, the officer asks Rob to perform a set of field sobriety tests.  Rob is asked to stand on one leg, walk heel-to-toe, and follow a pen with his eyes only.  Rob's balance and coordination were fine, but the officer concluded that Rob was not following directions because he began the tests before the officer was finished giving instructions.  The officer places Rob under arrest for DUI, citing Rob's inability to follow instructions, the strong odor of burnt marijuana and redness in Rob's eyes as the reasons to believe Rob was under the influence in violation of California's drunk driving laws.  Rob provides a blood sample at the station and knows that he will test positive for THC.

Rob hires a North Hollywood Criminal Defense Attorney for his DUI case.  Because Rob is charged with DUI involving drugs and not alcohol, he is not subject to the administrative suspension that starts 30 days after a DUI arrest.  He does not need to request a DMV hearing within 10 days to save his driver's license.  If he avoids a DUI conviction, he will not lose his license.  If convicted, the DMV's Mandatory Actions Unit would suspend his license for 6 months.

EXAMPLE:
Eric has a party at his loft in Downtown Los Angeles.  Over the course of the party, lots of people have come and gone, some staying longer than others.  Late in the night, a few party guests are still around and Eric goes to bed, leaving a few of his friends and their friends alone in the living room.  As the last guests leave, they leave the front door wide open.  One of the party guests also left a small bag, containing a small amount of cocaine on a couch.

EXAMPLE:
Ivan, a resident of East Los Angeles, is driving home from a family gathering in nearby Lincoln Heights.  He is pulled over by police and accused of running a stop sign.  As the officer approaches Ivan's window, he sees a pistol-shaped torch lighter on the passenger side seat.  He immediately orders Ivan out of the vehicle and handcuffs him.  The officer pats Ivan down, goes into his pockets and retrieves several small bags containing a white powder resembling methamphetamine.  Ivan is then placed under arrest for possession of a controlled substance (HS 11377).  The officers search the vehicle after placing Ivan in the squad car, and only then retrieve the torch lighter.  They also recover a loaded handgun in the back seat, as well as a scale and additional plastic bags.  Ivan is charged with HS 11370.1 (possession of a controlled substance with a firearm) and HS 11378 (possession/transportation of a controlled substance for sale).

Additionally, Ivan is not a United States Citizen and would be deported if convicted of the charged offenses. 
Upon the advice of his immigration attorney, Ivan hires a Los Angeles Criminal Defense Attorney to represent him in this serious case.  Upon reviewing the police report, Ivan's defense lawyer notices that the officer used seeing the torch lighter as justification for ordering Ivan out of the car, and the officer wrote that the torch lighter looked like a handgun.  The defense attorney writes a motion to suppress, and argues that the officer knew that the lighter was not a gun.  The officer used that as justification for an illegal search.  The officer also subpoena's the video footage from the patrol car and a nearby gas station to show how the officer did not use any urgency to recover the torch lighter, indicating that he knew it was not something dangerous.  The judge agrees and finds that the search was an unlawful search.  The evidence recovered gets suppressed and the case is dismissed.  Not only is Ivan no longer facing a possible prison sentence, but he will not longer face any negative immigration consequences.

EXAMPLE:
John, a plumber, has had back pain for several years.  His job involves a lot of strain on his back and he had previously been prescribed Vicodin to help him manage the pain.  After about 10 months of taking the medication, John could no longer afford health coverage, and could not afford to pay for frequent doctor's visits.  John's father also was prescribed pain medications, and gave John 20 pills each month so that John could manage to get through his hard work day.

One day, while John is backing out of a driveway at one of his job sites, he hits another vehicle.  An LAPD officer comes out to write up a traffic collision investigation report.
  While talking to both parties, the officer asks John if he takes any medications.  John admitted to the officer that he takes pain medication for his back.  The officer asked John to perform some field sobriety tests, and John agreed (note: he has a right to refuse to perform field sobriety tests and should refuse).  John lost his balance while trying to perform the one leg stand test.  John is arrested for DUI and taken to the station for a blood test.  He now must appear in Van Nuys Court to defend against charges that he violated VC 23152(a) and 23152(b).  Unlike alcohol-related DUIs, John will not need to schedule a DMV hearing.  His license will only be suspended if he is convicted of DUI.  Fortunately, John is not in possession of any of the pills his father had given him.  If he had been found with the pills, he would face a felony possession of a controlled substance charge per HS 11350.  It is also important to note that even if John has a valid prescription, he can still be prosecuted for DUI if the government shows that the medication has impaired his ability to drive.

EXAMPLE:
Amy is shopping at the Glendale Galleria with her two year old daughter.  After making a purchase at one store, Amy has a shopping bag from that store and enters another store.  In the second store, Amy's daughter grabs an item and starts playing with it.  While Amy is looking at other items, her daughter puts an item in the shopping bag.  Amy purchases a few items and proceeds out the door.  At the door, the security alarm alerts the store's loss prevention officers that an item is on its way out the door with a security sensor still active.

The store's loss prevention officer looks inside the bag and sees an unpaid for small electronic device.  Due to the value of the item, the loss prevention officers do not believe Amy, when she says that she does not know how the item got into the bag. 
With no prior criminal history, and never intending to take any item out of the store without paying, Amy is still arrested for shoplifting.  She is cited, released and asked to sign a paper acknowledging that she will not return to the store.  The ticket she is issued has a court date on it, and says that she must appear in court in about two months to answer to misdemeanor theft charges.

EXAMPLE:

Los Angeles Illegal Fireworks Lawyer

LA Illegal Fireworks Attorney
California's Health and Safety Code Sections 12500 to HS 12728 deal with the illegal possession and sale of fireworks.  Not all fireworks are illegal.  Some fireworks, defined under the law as "safe and sane" fireworks can be sold legally, but there are still strict rules for when they can be purchased, possessed, sold or used.  "Dangerous" fireworks are pretty much always illegal, except as permitted to pyrotechnics for the entertainment industry or large-scale Fourth of July or New Years, or Chinese New Year displays.

Fireworks have a great deal of cultural significance in the US, and play prominent roles in cultural celebrations throughout the world.  We want our families and children to experience the wonder and magic of a fireworks display.  In California, however, fireworks laws are quite strict.  Particularly in the Eastern portion of LA County, like East LA, San Gabriel, El Monte, Montebello and portions of Riverside and San Bernardino Counties.  The dry weather makes Southern California, especially the San Gabriel Valley region very susceptible to fires, and a simple fireworks display could lead to mass evacuation of homes as well as significant property damage.

"DANGEROUS FIREWORKS" VS. "SAFE AND SANE FIREWORKS"

Dangerous fireworks (pretty much always illegal) include, but are not limited to:
Examples of "dangerous" fireworks include (but are not limited to): (1) fireworks containing arsenic sulfide or arsenites, most chlorates, magnesium, most phosphorous, zirconium, or many other chemicals, (2) firecrackers, skyrockets, rockets, and sparklers larger than 10" in length or .25" in diameter, and (3) any other fireworks that the Fire Marshall has declared "unsafe for use by any person not specifically qualified or trained in the use of fireworks."

POSSESSION OF ILLEGAL FIREWORKS
Possession of illegal fireworks in California is typically a misdemeanor, punishable by up to one year in county jail.  Possessing any quantity of "dangerous fireworks" is a crime in California.  Again, some municipalities, pyrotechnic operators and amusement parks are permitted to have dangerous fireworks.  Possession of more than 25 pounds, but less than 100 pounds is still a misdemeanor, but is also punishable by a fine of up to $5000.  Possession of more than 100 pounds can be charged as a felony, and exposes the defendant to up to 3 years in State Prison.

SALE OF ILLEGAL FIREWORKS

It is also illegal to sell illegal fireworks.  Selling fireworks to minors is also a serious crime.  With possession of enough fireworks, it is possible to be charged with a felony, as well as several misdemeanor charges for a sale of illegal fireworks case.

CALIFORNIA ILLEGAL FIREWORKS LAWS

  • HS 12670 - Advertising for the "fireworks business" without license
  • HS 12671 - Engaging in any activity with fireworks that have not been classified and registered by the State Fire Marshall
  • HS 12672 - Selling or offering to sell fireworks outside of the allowed dates (June 28th-July 6th)
  • HS 12673 - Illegally storing fireworks
  • HS 12674 - Storing fireworks expired or revoked license
  • HS 12675 - Failing to record license number on fireworks sales or shipments
  • HS 12676 - Giving, delivering or selling dangerous fireworks to someone without permit
  • HS 12677 - Possessing dangerous fireworks without permit
  • HS 12678 - Discharging agricultural/wildlife fireworks without permit
  • HS 12679 - Storing, selling or discharging fireworks too close to a gas station or other area where flammable liquids are stored or dispensed
  • HS 12680 - Discharging fireworks where they are likely to harm another person or with intent to cause fear, chaos or panic
  • HS 12681 - Selling "safe and sane" fireworks anywhere other than a fixed, licensed place of business
  • HS 12682 - Allowing a "fire nuisance" to exist in a place where fireworks are sold, manufactured, packaged or stored.
  • HS 12683 - Selling, using or discharging a flare/flare gun that has not been registered with the State Fire Marshall.
  • HS 12684 - Using a flare/flare gun in unintended manner.
  • HS 12685 - Conducting a public display of fireworks without permit
  • HS 12686 - Using special effects fireworks without pyrotechnic license
  • HS 12687 - Selling, giving, transferring or delivering special effects fireworks to anyone without pyrotechnic license
  • HS 12688 - Advertising to sell or transfer fireworks without license or permit.
  • HS 12689 - Selling/delivering fireworks to minors.
  • HS 12690 - Operating with an expired license

EXAMPLE
:

Ben purchases several boxes of fireworks at a garage sale.  Neither Ben, nor the seller, know that it is illegal to possess these particular fireworks, but they are "dangerous fireworks" within the meaning of California's fireworks laws.  Ben plans to light some of the fireworks himself, and to give some away to friends.  One of Ben's friends tells Ben that he can make a lot of money selling the fireworks he bought at the garage sale.  Ben posts an ad on Craigslist offering to sell the fireworks.  He gets several responses, one of them from an undercover detective in the El Monte Police Department.

The undercover detective offers to buy all of the fireworks at Ben's full asking price.  They arrange to meet at a parking lot the following morning.  Upon arriving to the parking lot, Ben notices a car that fits the description given to him by the buyer, drives up and initiates a conversation.  The (still undercover) officer confirms the price, and that Ben has the fireworks.  He asks to see one box, and soon after, uniform police officers move in and arrest Ben. 

The sting operation produces some pretty strong evidence against Ben, and he is charged with HS 12676 (selling illegal fireworks) and HS 12688
(advertising sale of fireworks).  Ben hires a Los Angeles Criminal Defense Attorney who assesses Ben's defenses (did not possess, did not intend to sell, was not the same person in the communication, etc.) and works with the District Attorney's office in El Monte to try to get Ben the best outcome possible in the case.

Ricky has a party at his apartment on Edgemont Street in Los Feliz.  He invites several friends, who each invite more friends, and eventually, it is loud, crowded and there are a lot of guests Ricky does not know.  As the night wears on, a few party guests are still around as Ricky falls asleep.  The last guests leave, leaving the front door wide open.  One of the party guests also left a small bag, containing a small amount of cocaine on a coffee table.

A few hours later, the LAPD drives down Ricky's street and see's the wide open apartment door.  They decide to approach the apartment and investigate.  They knock on the door for several seconds and then enter, uninvited.  They see the bag in plain sight on the coffee table and and believe it to contain an illegal drug, cocaine.  They wake up Ricky and place him under arrest for possession of a controlled substance in violation of Health and Safety Code 11350.  (more on California Drug Crimes)

HONESTY: Attorneys have a reputation for dishonesty.  Unfortunately, it's not completely unfounded.  Many attorneys will use scare tactics, pointing to the maximum possible punishments, knowing that this is extremely unlikely.  If you are a first time offender, and an attorney tells you you are going to do serious time on an insignificant charge, they are likely just trying to scare you into paying them large sums of money.  Also beware of attorneys purporting to make guarantees.  Without reviewing the evidence in a case, no attorney can 100% guarantee a particular outcome.  Also approach with caution if an attorney boasts having "connections" or playing golf with the judge or prosecutor.  Prosecutors respond to cogent arguments and effective negotiation; not made up social connections.

SKILL: Discuss past success with your prospective attorney.  Judging how an attorney will perform in your case is a difficult task.  Past success is probably the best indicator you might have.  You want an attorney who is intelligent, knowledgeable of the law, but most importantly, one who gets results for his or her clients.

PASSION:  Does your prospective lawyer seem 100% dedicated to helping those charged with crimes?  Many attorneys will boast having prior experience working as prosecutors.  Do they have the same dedication to criminal defense as attorneys who have worked ONLY on the defense side?

EXPERIENCE:  Your lawyer should have a proven track record of success in criminal cases, handling matters in your jurisdiction and should be thoroughly familiar with the laws and process you are facing.
