![]() INGLEWOOD CRIMINAL DEFENSE ATTORNEY AND DUI LAWYER Inglewood, CA, the "City of Chapions" is located on the border between LA's "South Bay" and "South LA"/"South Central" regions in Southwestern Los Angeles County. With close proximity to the beach (Venice, Manhattan Beach, Hermosa Beach, Redondo Beach), LAX Airport and the West Side, Inglewood is pretty centrally located and an important piece of Los Angeles history. Some neighborhoods in Inglewood include: Crenshaw-Imperial, Morningside Park, Arbor Village, Downtown Inglewood, North Inglewood and Fairview Heights. Neighboring towns/regions include: Lennox, Hawthorne, Ladera Heights, El Segundo, Los Angeles (South LA) and more. Nearly 110,000 people call Inglewood Home. Inglewood is a predominantly African-American and Latino community, with each group accounting for nearly half of the total population. Many famous people have come out of Inglewood and the town is frequently represented in popular culture, as the setting for movies, music videos and mentions in songs. Crime is higher in Inglewood than in 76% of other cities in the US, so higher than average, and has higher Murder, Robbery and Assault rates than the national average. Auto thefts are nearly double the national average, but burglaries and other property crimes are actually below the national average in Inglewood. Inglewood is policed by the Inglewood Police Department, and both criminal and traffic matters go to the Inglewood Courthouse. The kind and severity of criminal offenses vary greatly in Inglewood. Everything from minor offenses like petty theft and vandalism, up to serious gang-related crimes, and violent offenses. Drug crimes are also common in Inglewood and run the gamut from simple marijuana possession, up to serious drug sales conspiracy charges. As with any other location in Los Angeles, DUI enforcement is in full force, with checkpoints, saturation points and DUI targeted enforcement at the times and locations where DUI is most frequent, and aggressive prosecution for Domestic Violence. If you have been arrested or charged with a crime, you have a right to counsel. You need a Los Angeles Criminal Defense Attorney who will assert your rights and fight for the best possible outcome in your criminal case. Speak to a Los Angeles Criminal Defense Lawyer at the Law Offices of Nicholas Loncar now. Consultations are free, and we can help you understand the charges, your options and any defenses you may have in your case. EXAMPLE: James lives in Inglewood, CA. James recently graduated high school and will be headed to college in the fall at USC. James is driving on Crenshaw Blvd in a car that he borrowed from his friend to go pick up some supplies for the start of school. James is pulled over by Inglewood PD, but is certain that he did not commit any traffic violations. James cannot locate the car's papers. Unknown to James, his friend had taken the car from a neighbor without permission. The car was not yet reported stolen, but the officer is suspicious that James does not have the car's documentation and has James wait while he verifies the ownership of the vehicle. After approximately 20 minutes, the officer arrests James for Grand Theft Auto (PC 487(d)(1)). James bails out and hires a Los Angeles Criminal Defense Lawyer to represent him. James' attorney gets to work right away, having a private investigator interview witnesses. Forwarding his findings to the Inglewood Police and the LA County District Attorney's office, James' lawyer is able to convince the DA to file the matter as a misdemeanor VC 10851 (joyriding) instead of Grand Theft Auto. This is important because James does not want to have even a felony charge on his record, let alone a conviction. The attorney's investigator also pulls video footage from nearby business on Crenshaw Blvd that would have caught James' driving pattern and subpoena's the video footage from the patrol car. The officer's claim that James ran a red light was not true, and the defense has proof. Once the case has proceeded to court, as a misdemeanor, at Airport Courthouse by LAX, Jame's lawyer files a motion to suppress, arguing that the officer violated James' Fourth Amendment rights by pulling him over for no reason. With strong video evidence to support the defense's argument, the lawyer is able to convince the judge to throw the evidence out, and the case is dismissed. ![]() Lancaster, CA is one of the fastest growing cities in Los Angeles County, and all of California. In the 1970s, the town had just over 30,000 residents, and has now boomed to a population of over 150,000. Located approximately an hour north of Downtown Los Angeles, in the Antelope Valley, Lancaster is located in the Western Mojave Dessert, and has a hot, dry climate compared with much of LA County. Along with Palmdale, Lancaster is pretty isolated as the only highly populated areas of the Antelope Valley. Lancaster does not have its own police department. The LA County Sheriff's Department provides law enforcement services to Lancaster. Criminal and traffic matters in Lancaster are heard at the Antelope Valley Courthouse in Lancaster. Criminal charges in Lancaster vary in severity and it type, with drug crimes, DUI, domestic violence and theft crimes being the most common. True to its reputation, Lancaster does have a significant number of methamphetamine cases. From simple possession, up to sale, transportation and manufacture, "meth" has a strong presence in the Antelope Valley. The Los Angeles District Attorney's office is very aggressive with its prosecution of DUI, second DUI, and Domestic Violence cases. Lancaster has tough judges and tough juries as well. Having the best representation you can get is imperative to getting a good outcome in your case. Whether you are guilty or have been wrongfully accused, you need a powerful Los Angeles Criminal Defense Attorney or DUI Lawyer to fight for you and assert your rights. Whether avoiding jail time, immigration consequences or avoiding a misdemeanor or felony conviction, your goals should be your lawyer's top priority. The Law Offices of Nicholas Loncar provide Lancaster and Antelope Valley clients with passionate, skilled legal services at a fair and reasonable price. If you have been arrested or charged with a crime in Lancaster, or anywhere else in LA County, contact the Law Offices of Nicholas Loncar for a free consultation with a Lancaster Criminal Defense Attorney or DUI Lawyer. We can go over your arrest and the charges you may be facing. Being arrested is scary, but knowing and understanding the court process, the likely outcomes and the steps being taken to protect you help you feel at ease, knowing your case is in the hands of a great attorney. EXAMPLE: Tim is driving home to Lancaster from a bar in Palmdale. Tim had been drinking beer while watching a football game. In all, he had three beers, including chugging his last beer right as he left the bar and got in the car to drive. Ten minutes later, and a few blocks from his house, Tim comes across a LA County Sheriff's DUI checkpoint on Avenue J. When Tim rolls his window down, the officer can smell the beer on his breath and asks Tim whether he had been drinking, and when. Tim tells the officer he had two beers, while watching the game less than an hour ago. Wisely, Tim exercises his rights not to perform any of the field sobriety tests that the officers request of him. The field sobriety tests are difficult to perform, and nerves, fear, medical conditions and many other factors can interfere with "passing" field sobriety tests, even if sober. Tim also had a right to refuse the Preliminary Alcohol Screening (PAS) test, a handheld breathalyzer, used by law enforcement at the scene to determine whether someone is DUI. Tim does submit to the test, and the two readings register .080 and .085, several minutes apart. Tim is arrested for DUI and transported to the station for booking. Tim is then asked to provide a breath sample into the breath testing device at the station, now an hour after driving. Tim's two breath samples measure .105 and .112. Upon patting Tim down to put him in a cell, the Sheriff's deputy finds a small bag containing methamphetamine. Tim can now be charged with HS 11377 (possession of a controlled substance - to wit Methamphetamine) or PC 4573 (bringing contraband into a jail). The District Attorney charges Tim with both a misdemeanor DUI (VC 23152(a) and VC 23152(b)) and a felony for bringing methamphetamine into a jail. Despite the serious charges, Tim's Los Angeles Criminal Defense Attorney has a lot to work with in this case. With respect to the DUI, the government must prove that Tim was above .08 at the time of driving. Tim's Los Angeles DUI Lawyer will assert the rising BAC defense, and show that Tim was still absorbing alcohol at the time he was driving. Only after time passed was he over the legal limit. Regarding the PC 4573 charge, Tim has a strong knowledge defense. He was not planning to be arrested, and once he was, the only way he could have stopped himself from committing the offense was to give up his Fifth Amendment right against self-incrimination and he was not asked about whether he had any contraband on his way into jail. He did not have to volunteer anything. The felony charge could very well be dismissed at the preliminary hearing, or by a PC 995 motion to dismiss, and the DUI may be won at trial or reduced to a reckless driving through negotiation. If you have been arrested or charged with a crime in Lancaster, Palmdale or anywhere else in LA County, contact the Law Offices of Nicholas Loncar to discuss your case with a Los Angeles Criminal Defense Attorney and DUI Lawyer. Consultations are free and can really help you understand what is going on in your criminal case. Nicholas M. Loncar, Esq. West Covina is patrolled by the West Covina Police Department, with LA County Sheriff, El Monte PD,California Highway Patrol and others controlling surrounding areas. Crimes are prosecuted by the Los Angeles District Attorney's office at West Covina Courthouse. Our Los Angeles Criminal Defense Lawyer office is located on Ventura Boulevard in Los Angeles' Studio City neighborhood. West Covina has fairly average crime rates for LA County, for California and the nation. There is some street gang presence, but drug crimes, DUI, domestic violence and theft offenses make up most of the criminal charges in West Covina. If you have been arrested or charged with a crime in West Covina, a Los Angeles Criminal Defense Lawyer in nearby Echo Park can help. In DUI cases, we can help you assert the defenses available (Including: Mouth Alcohol, Rising BAC, How Accurate are Breathalyzers?, Did Police Follow Proper Testing Procedure, Do Field Sobriety Tests Prove Anything, Alcohol and Drugs are NOT the Only Causes of Bad Driving). For theft offenses, there may be an opportunity to reach a civil compromise dismissal with merchants. Drug crimes and weapon offenses might have viable motions to suppress if the police violated your rights. This is a confusing, difficult time. If you have been arrested, charged with a crime or even cited for a traffic violation, you undoubtedly have questions about what to expect and what to do next. With a free consultation with a Los Angeles Criminal Defense Attorney, you can ask those questions and get meaningful, tailored to your case, and carefully explained answers. We will identify the best course of action, and get started working for your defense. Contact our office now for a free consultation with a Los Angeles Criminal Defense Lawyer. We can discuss the details of your case, go through the possible defenses and explain the court process to you in detail. If you've been arrested or charged with a crime in West Covina, Covina, Azusa, El Monte, Montebello, or anywhere else in Los Angeles, the Law Offices of Nicholas Loncar can help. EXAMPLE: Bill, a licensed contractor, has had back pain for several years. His job involves a lot of strain on his back and he had previously been prescribed Vicodin to help him manage the pain. After about 10 months of taking the medication, Bill could no longer afford health coverage, and could not afford to pay for frequent doctor's visits. Bill's father also was prescribed pain medications, and gave Bill 20 pills each month so that he could manage to get through hard work days. One day, while Bill is backing out of a driveway at one of his job sites, he hits another vehicle. A West Covina Police Department officer comes out to write up a traffic collision investigation report. While talking to both parties, the officer asks Bill if he takes any medications. He admitted to the officer that he takes pain medication for his back. The officer asked him to perform some field sobriety tests, and Bill agreed (note: he has a right to refuse to perform field sobriety tests and should refuse). Bill lost his balance while trying to perform the one leg stand test, due to the pain in his back. Bill is arrested for DUI and taken to the station for a blood test. He now must appear at the West Covina Courthouse to defend against charges that he violated VC 23152(a) and 23152(b). Unlike alcohol-related DUIs, Bill will not need to schedule a DMV hearing. His license will only be suspended if he is convicted of DUI. To make matters worse, upon conducting a search of Bill's vehicle, the officers find the pain pills he got from his father. Without a prescription, possession of opiate pain medications like oxycodone and hydrocodone is a felony per HS 11350. Bill hires a Los Angeles Criminal Defense Attorney to represent him in his DUI case. Bill's lawyer has an accident reconstructionist interview the client, the other driver and the police officers accident report, and has a toxicology expert review the blood results and provide a declaration or direction for the defenses. The attorney also gets a statement from Bill's physician stating that his back problems would make it difficult for him to stand on one leg. Relying on the government's evidence (the evidence in the officer's report) is not likely to get the best result. But with independent, new evidence, Bill has a much better chance to get a dismissal, a reduced charge, or, if necessary, win his DUI case at a jury trial. He will also have to deal with a felony drug possession charge. Getting Bill into a diversion program is important to help him keep his record clean and keep his contractor's license in tact. Nestled in between Bel Air, Beverly Hills, Holmby Hills, Brentwood, West Los Angeles and Santa Monica on LA's west side, Westwood is an affluent, upscale area with a wide range of dining, retail and nightlife options for college students and young professionals alike. In addition to the UCLA Campus, and the Westwood Village downtown area right by the campus, Westwood is home to some upscale apartments, condominiums and homes. Westwood is generally considered a safe community. Although there was a gang shooting in Westwood in 1988, the area does not see much of Los Angeles' urban crime. With a large university population, many of the crimes and arrests in the area are minor alcohol and drug-related offenses. Less frequent, but not uncommon are more serious drug crimes (sales offenses, overdoses), sexual assaults, vandalism and DUI. Domestic violence enforcement is a high priority for police and prosecutors throughout Los Angeles, and Westwood is no exception. As with many high-traffic areas with a large retail presence, there are petty theft and shoplifting offenses in Westwood. Westwood is patrolled by the Los Angeles Police Department, who operate out of the nearby West Los Angeles Community Police Station. The UCLA Police Department and University of California (Statewide) Police Department handle matters taking place on UCLA's campus. Criminal matters in Westwood proceed to the Airport Courthouse near LAX (a short ride down the 405). Traffic matters go to Santa Monica Courthouse. Law enforcement in Westwood specifically target drug and alcohol-related activity, and organize DUI checkpoints, fake ID sting operations and sting operations for narcotics. If you have been arrested in Westwood, it is important to have a Los Angeles Criminal Defense Attorney to protect and assert your rights. For more information about your Fourth Amendment rights against unlawful search and seizure, take a look at the following articles on search and seizure law: Stop and Frisk and Search of Persons, What constitutes a search?, Consent Searches, Search of Vehicles and Effects, How to Suppress Evidence. In Westwood and Los Angeles DUI cases, some of the most common defenses include: Mouth Alcohol, Rising BAC, How Accurate are Breathalyzers?, Did Police Follow Proper Testing Procedure,Do Field Sobriety Tests Prove Anything?, Other Causes of Bad Driving Pattern. EXAMPLE: Sara, a 19 year old UCLA student is celebrating another weekend as a college student at a local sports bar in Westwood. Last year, upon arriving at UCLA, Sara purchased a fake ID in order to be able to go to bars, clubs and other venues. The ID, having Sara's true photograph and name, use a different birth date, so that she can pass herself off as 22 and go to bars and clubs in Westwood, West Hollywood, Santa Monica and the rest of Los Angeles. Previously unknown to Sara, the LAPD operates a sting operation at her campus to catch people with fake IDs. With the ID in their possession, the police have all of the evidence they need to arrest Sara and charge her with PC 470b, PC 472 or VC 13004(g) or BP 25661 (possession of fake ID by a minor). Although the offense did not involve driving, Sara would suffer a one year driver's license suspension in addition to the possible criminal penalties associated with a misdemeanor. Misdemeanors are also punishable by up to a year in LA County Jail and fines of up to $1000. As a "crime involving moral turpitude" a fake ID case can carry immigration consequences for non-citizens and affect employment prospects. Sara hires a Los Angeles Criminal Defense Attorney to handle her case and keep his record as clean as it can be. Sara's defense lawyer attends court at Airport Courthouse on Sara's behalf. At arraignment, the lawyer enters a not guilty plea and gets another court date to come back and negotiate with the prosecution. At the subsequent court date, the attorney is able to convince the officer to amend his citation to allow for a different infraction charge that will not lead to a driver's license suspension. Sara is responsible for paying a small fine, but avoids a misdemeanor conviction on her record and gets to keep her driver's license. If you have been arrested or charged with a crime in Westwood, or anywhere else in Los Angeles, contact our office and speak to a Los Angeles Criminal Defense Attorney now about your case. A lawyer will listen to you and help you understand the defenses, possible consequences and best course of action for your criminal case. For more information on your Fourth Amendment rights against unlawful search and seizure, take a look at the following articles on search and seizure law: Stop and Frisk and Search of Persons, What constitutes a search?, Consent Searches, Search of Vehicles and Effects, How to Suppress Evidence. EXAMPLE: Tom is driving in Santa Monica, on his way to meet some friends to watch a football game at a sports bar. Tom runs a red light and is pulled over by SMPD officers. Tom's license had previously been suspended for DUI, and he had not yet fulfilled the obligations to restore his license or get a restricted license with the DMV. Tom had not been drinking, but the officer has Tom submit to some field sobriety tests and blow into a preliminary alcohol screening (PAS) device to test his blood alcohol concentration (BAC). Tom passes the FSTs and blows a .00 on the PAS test. Nevertheless, Tom is arrested for driving on a suspended license in violation of VC 14601.2, for driving while his license is suspended for DUI. His car is impounded for 30 days and he is now facing a misdemeanor charge, a probation violation in his DUI case. To make matters worse, an inventory search of Tom's vehicle yields some "wax" (a marijuana concentrate, for which he does not have a valid doctor's recommendation), a violation of HS 11357(a), which may be charged as a misdemeanor or a felony (more on marijuana laws). Tom hires a Los Angeles Criminal Defense Attorney to handle his probation violation and marijuana concentrate case. The burden is lower on the government in probation violation hearings, and the defendant does not have the same rights to a jury trial on the violation. As such, Tom's lawyer is able to convince the prosecution not to file any new charges, on the VC 14601.2, or on the marijuana concentrate charge. In exchange for getting his license in order with the DMV, Tom will not do any jail time and will not suffer any new convictions. He must pay a small probation revocation fine and continue to abide by the terms of his court probation. With the help of his Los Angeles DUI Lawyer, Tom has gotten back on track, got his license and vehicle back and will still be able to expunge his DUI conviction when he is done with probation. EXAMPLE: Steve is driving from a night out in Venice, driving through Culver City, when he encounters a DUI checkpoint, conducted by the Culver City Police Department. Two years earlier, Steve had been arrested for DUI, after driving home from a Fourth of July party, where he had been drinking. In that case, his attorney was able to negotiate a reduction from DUI to a "wet reckless" helping Steve avoid a suspension of his driver's license and Los Angeles' Ignition Interlock Device (IID) requirement for first time DUI offenders. Steve has taken the case seriously and does not drink and drive anymore. Steve is also prescribed Xanax for anxiety. Upon contact, the officer does not smell alcohol, but suspects that Steve is under the influence of alcohol. The officer asks Steve to step out of the car and to perform a series of field sobriety tests, and those test show Steve has poor balance. Next, he is asked to provide a breath sample into a handheld breathalyzer known as a "PAS" or "Preliminary Alcohol Screening" device. The PAS yields a reading of 0.00, because he had not been drinking. The officer asks Steve whether he'd taken any drugs or medications. Steve stated to the officer that he had taken Xanax, as prescribed by his doctor. Steve is arrested for DUI and asked to give a blood sample. While Steve would have had every right to refuse the field sobriety tests and the PAS device, he had to submit to the blood test to avoid a 1 year driver's license suspension s charged with a second DUI in Los Angeles Superior Court (Airport Courthouse). The prior wet reckless is alleged as a prior DUI. This is a common scenario. While a prescription for drugs like Xanax will protect a patient from criminal drug charges, a prescription does not provide immunity from prosecution for DUI. At some levels, Xanax, Valium, Percocet and other drugs can impair a person's ability to drive. Even if not warned, driving while impaired by prescription drugs is just as much of a crime as driving after drinking too much alcohol. Steve's Culver City Criminal Defense Attorney can raise some important defenses on his behalf. First, there is no set, legal limit with drugs other than alcohol. This means that the prosecutor must prove more than the presence of some level of the drug, but must actually prove that the level impaired Sam's ability to safely operate a motor vehicle. Xanax is a difficult drug to detect the effects of (only certified Drug Recognition Experts may say that they observed symptoms of drug impairment) and also is a fast tolerance building drug. The defense can consult with and call as witnesses, toxicology and pharmacology experts who can help explain these facts. Steve's primary care physician can help to explain any conditions Sam has that have the potential to disrupt his balance and explain Steve's pattern of Xanax use over the years to help establish a tolerance defense. After Steve's lawyer brings the weaknesses in their case to the DA's attention, the DA agrees to once again give Steve a "wet reckless" reduced charge. Steve now has two priorable offenses, but no DUI conviction. Not only is Steve not going to be punished as if his case were a second DUI, but he is also able to avoid the jail time, license suspension and ignition interlock device (IID) installation required after a DUI conviction. EXAMPLE: Rick is out at a bar in Long Beach. He is a regular at the bar and knows many of the other bar patrons personally. Throughout the evening, Rick goes in and out of the bar to smoke cigarettes, greeting people he knows, shaking hands and hugging. A bouncer at the bar sees Rick talking to different people and shaking hands and suspects that Rick is selling drugs. The bouncer alerts the bar manager, who calls over a Long Beach Police Department officer parked on the corner. The bouncer tells the officer that he saw Rick exchange something for money with several bar patrons. The bouncer also tells the officer that he overheard other bar patrons talking about buying "Molly" and "coke" from a guy in a grey hoodie. The officer approaches Rick and asks him to come outside of the bar with him. Rick agrees. The officer asks Rick if he has anything illegal on his person. Rick notifies the officer that he is a medical marijuana patient, and shows the officer two small bags of marijuana and a small jar, containing marijuana concentrate. Rick does not have his medical marijuana recommendation with him, and the officer places him under arrest for possession of concentrated cannabis. Upon searching Rick's pockets, the officer also finds five pills of "Molly" (an MDMA drug). Rick is charged with possession of a controlled substance for sale (HS 11379). Rick hires a Long Beach Criminal Defense Attorney to represent him in court. His lawyer prepares a motion to suppress the evidence, arguing that the arrest for possession of concentrated cannabis was not supported by probable cause, due to Rick's statement to the officer that he was a medical marijuana patient. Rick's lawyer is able to persuade the District Attorney to offer a simple drug possession misdemeanor (HS 11377), which is elgible, under PC 1000, for deferred entry of judgment, a diversion program that will allow Rick to avoid jail and a criminal conviction. Upon completion of a drug class, Rick will have his case dismissed and will not even have a misdemeanor conviction. Being arrested or charged with a crime is scary, stressful and embarrassing. EXAMPLE: A high-end jewelry store in Beverly Hills is robbed at gunpoint. Video surveillance in the store show two people, a man and a woman, leaving the store as the gunman enters. The gunman has a mask covering his face and . The robber points the gun in the clerk's face and demands that she put as much jewelry and cash as she can fit into two duffel bags he brought with him. Later that evening, local news stations display the video footage and urge anyone with information to contact Beverly Hills Police. Next, Beverly Hills gets an anonymous tip on their tip line, identifying one of the two customers who exited the store, holding the door open for the gunman to enter. Upon reviewing the footage, the investigating detective suspects that the couple who entered the store first, entered posing as customers, but were in fact involved in the planning and execution of the robbery. Based on the anonymous tip, the detective brings Joe in for questioning. Joe is kept in an interrogation room and repeatedly asked about the robbery, accused of intentionally holding the door open so that the gunman could get in. Joe continues to deny any wrongdoing. The police then use a deceptive tactic, and tell Joe that his girlfriend (whose identity is still actually unknown to police) is in the other room, explaining the arrangement. Joe is not convinced, remembering that the officers had earlier asked him to identify the woman with him in the video, but that he refused. The gunman is never apprehended, but the police arrest Joe for what they believe to be his involvement in the crime. He is charged with robbery (PC 211) and criminal conspiracy (PC 182). Joe posts bail and hires a Los Angeles Criminal Defense Attorney to represent him at LAX courthouse. Joe's defense lawyer reviews the videotape, and the rest of the investigation, appoints a private investigator to question the witnesses and subpoenas other stores' video tapes to look for footage that might help show Joe's innocence. Joe's attorney sets up a meeting with the District Attorney, to show footage from several other stores, where Joe and his girlfriend had been shopping. Joe made purchases in some of the stores, and, over the course of nearly two hours, entered and exited several other stores, none of which were robbed. Additionally, the jewelry store surveillance video appears to show Joe holding the door for his girlfriend right before the gunman runs in. The District Attorney files charges anyway, and Joe's case proceeds to preliminary hearing. At preliminary hearing, with a strong cross-examination of the investigating detective, Joe's lawyer is able to convince the judge that the government lacks evidence of criminal activity and moves to have the charges dismissed. The judge grants the motion and Joe is free to go. He also may petition to have his arrest record sealed. Being arrested or charged with a crime is scary, stressful and embarrassing. Additionally, the phrase is often used to reference a larger area, LA's "Westside" which would include Santa Monica, Culver City, Beverly Hills, Century City, West Hollywood, Brentwood and more. Upscale and affluent, West Los Angeles is a suburban community, home to pricy real estate, fine dining, as well as high end commercial and retail businesses. Expensive luxury cars and high priced fashions are the norm. The Los Angeles Police Department (LAPD) and LA County Sheriff patrol West LA and the California Highway Patrol policing the freeways that cut through and surround West LA (the 10 and 405). West LA is a safe community with relatively low crime for LA County. Nevertheless, crimes (and arrests and criminal charges) do occur. West LA sees arrests and criminal charges for drug crimes, DUI and domestic violence, all the way up to violent felonies like rape and homicide. Most West LA criminal court matters will be heard at the Airport Courthouse, near LAX and El Segundo. Traffic matters may proceed to Beverly Hills or Santa Monica, depending upon the exact location. If you have been charged with a DUI offense in West LA, your Los Angeles DUI Lawyer can help you avoid a criminal conviction, a license suspension or jail time. There are many defenses in DUI cases and an arrest does not have to mean a conviction. Some of the most common defenses in DUI cases are: Mouth Alcohol, Rising BAC, How Accurate are Breathalyzers?, Did Police Follow Proper Testing Procedure, Do Field Sobriety Tests Prove Anything, Alcohol and Drugs are NOT the Only Causes of Bad Driving). In drug possession, weapon possession and theft offense cases, the best defense is often to use a motions to suppress any evidence that is obtained in violation of your constitutional rights. If you were subject to an unlawful search or the police lacked probable cause to make an arrest in your case, your Los Angeles Criminal Defense Attorney will fight hard to assert your rights and get the best possible outcome in your case. EXAMPLE: Jared is driving down Wilshire Boulevard, on his way to meet some friends to watch a football game at a sports bar. Jared runs a red light and is pulled over by LAPD officers. Jared's license had previously been suspended for DUI, and he had not yet fulfilled the obligations to restore his license or get a restricted license with the DMV. Jared had not been drinking, but the officer has Jared submit to some field sobriety tests and blow into a preliminary alcohol screening (PAS) device to test his blood alcohol concentration (BAC). Jared passes the FSTs and blows a .00 on the PAS test. Nevertheless, Jared is arrested for driving on a suspended license in violation of VC 14601.2, for driving while his license is suspended. His car is impounded for 30 days and he is now facing a misdemeanor charge, a probation violation in his DUI case. To make matters worse, an inventory search of Jared's vehicle yields some "wax" (a marijuana concentrate, for which Jared does not have a valid doctor's recommendation), a violation of HS 11357(a), which may be charged as a misdemeanor or a felony (more on marijuana laws). Jared hires a Los Angeles Criminal Defense Attorney to handle his probation violation and marijuana concentrate case. The burden is lower on the government in probation violation hearings, and the defendant does not have the same rights to a jury trial on the violation. As such, Jared's lawyer is able to convince the prosecution not to file any new charges, on the VC 14601.2, or on the marijuana concentrate charge. In exchange for getting his license in order with the DMV, Jared will not do any jail time and will not suffer any new convictions. He must pay a small probation revocation fine and continue to abide by the terms of his court probation. With the help of his Los Angeles DUI Lawyer, Jared has gotten back on track, got his license and vehicle back and will still be able to expunge his DUI conviction when he is done with probation. With historic neighborhoods like West Adams, world class institutions like the University of Southern California and of course, being home to the LA Coliseum, South LA has a lot more to it than the drive-by shootings depicted in movies. Nearly 750,000 Angelenos call South LA home. There are also several thriving business districts and small business owners have been maintained a strong presence in the neighborhoods making up South LA. From USC to Watts, South LA has a unique identity, but also very different feel from neighborhood to neighborhood. Some other neighborhoods in South LA include: Athens, Florence, Manchester, Leimart Park, Hyde Park, Crenshaw, Slauson and Baldwin Hills. The Los Angeles Police Department (LAPD) patrols South LA, with the LA County Sheriff having jurisdiction over the Metro stations and the California Highway Patrol policing the freeways that cut through and surround South LA. As its notoriety would suggest, South Central LA arrests and criminal charges run the gamut from theft crimes, drug crimes, DUI and domestic violence, all the way up to violent felonies like rape and homicide. With heavy drug, gang and other criminal activity, there are many criminal cases coming out of South LA. Depending on the geographic location and severity of the offense, South LA cases may be heard at the Clara Shortridge Foltz Criminal Justice Center (Criminal Courts Building), or Metropolitan Courthouse, Inglewood Courthouse, and Compton Courthouse, depending on the exact location. If you have been charged with a DUI offense in South LA, your Los Angeles DUI Lawyer can help you avoid a criminal conviction, a license suspension or jail time. EXAMPLE: Aaron, a 19 year old University of Southern California student is celebrating another weekend as a college student at a local sports bar on Figueroa. Last year, upon arriving at USC, Aaron purchased a fake ID in order to be able to go to bars, clubs and other venues. The ID, having Aaron's true photograph and name, use a different birth date, so that Aaron can pass himself off as 22. Previously unknown to Aaron, the LAPD operates a sting operation at his campus to catch people with fake IDs. With the ID in their possession, the police have all of the evidence they need to arrest Aaron and charge him with PC 470b, PC 472 or VC 13004(g) or BP 25661 (possession of fake ID by a minor). Although the offense did not involve driving, Aaron would suffer a one year driver's license suspension in addition to the possible criminal penalties associated with a misdemeanor. Aaron hires a Los Angeles Criminal Defense Attorney to handle his case and keep his record as clean as it can be. Aaron's defense lawyer attends court at Metropolitan Courthouse on Aaron's behalf. At arraignment, the lawyer enters a not guilty plea and gets another court date to come back and negotiate with the arresting officer. At the subsequent court date, the attorney is able to convince the officer to amend his citation to allow for a different infraction charge that will not lead to a driver's license suspension. Aaron is responsible for paying a small fine, but avoids a misdemeanor conviction on his record and gets to keep his driver's license.
