EXAMPLE OF A VALLEY VILLAGE ARREST AND CRIMINAL CASE:
Sal, a Valley Village resident and bartender at a restaurant in Studio City, is getting off of work after a long shift one night.  He drives home and sees two car parked in his driveway.  One car belongs to his girlfriend, the other he does not recognize.  Sal enters his home and overhears his girlfriend, Jen having sex with someone else.  He barges into the bedroom, catches his girlfriend cheating on him and starts yelling at both of them.  He demands that the unknown man get out of his house immediately.  He says "if you don't get out of here right now, I'm going to kill you."

The man leaves and calls the police, describing to them what had just happened.  LAPD officers go to Sal's house to see what is going on.  Upon arrival, they find Sal throwing his girlfriend's belongings out onto the front curb.  She is standing in the driveway, by her car crying and screaming.  Jen has red marks on her neck from having sex with the other man, but Sal did not hit, push or touch Jen.  Angry about Sal's reaction, Jen tells the officer that Sal pushed her, slapped her in the face and choked her.

Sal is arrested under felony charges for causing injury to a spouse or cohabitant (PC 273.5) and criminal threats (PC 422).  Sal has no criminal record.  He bails out and hires a skilled Los Angeles Criminal Defense Attorney to aggressively pursue a dismissal of his case.  Sal's lawyer gets a private investigator to question Jen as well as the man she had been cheating on Sal with.  Jen admits that she was angry and that Sal did not touch her.  The man also admits that he put his hand around Jen's neck, at her request during a consensual sexual encounter.  Further, both witnesses say that the alleged threat was conditional on the man leaving the house.  Conditional threats do not fall within the conduct made illegal under PC 422.

Sal's attorney forwards the investigator's reports to the LAPD detective assigned the case and to the LA District Attorney's Office in Van Nuys.  The reports convince the DA's office to reject the case, and it is sent to the LA City Attorney's Office, also in Van Nuys.  Sal's lawyer forwards the investigative reports to the City Attorney's office as well, and sets up a meeting with the prosecutor.  The City Attorney's office agrees not to file the case.  Not only will Sal not have a criminal conviction, but because his case was not file, he is eligible to petition the court to seal and destroy his arrest record.  This is a great outcome for Sal, and the right outcome, considering he had done nothing wrong.
