EXAMPLE: A high-end jewelry store in Beverly Hills is robbed at gunpoint. Video surveillance in the store show two people, a man and a woman, leaving the store as the gunman enters. The gunman has a mask covering his face and . The robber points the gun in the clerk's face and demands that she put as much jewelry and cash as she can fit into two duffel bags he brought with him. Later that evening, local news stations display the video footage and urge anyone with information to contact Beverly Hills Police. Next, Beverly Hills gets an anonymous tip on their tip line, identifying one of the two customers who exited the store, holding the door open for the gunman to enter. Upon reviewing the footage, the investigating detective suspects that the couple who entered the store first, entered posing as customers, but were in fact involved in the planning and execution of the robbery. Based on the anonymous tip, the detective brings Joe in for questioning. Joe is kept in an interrogation room and repeatedly asked about the robbery, accused of intentionally holding the door open so that the gunman could get in. Joe continues to deny any wrongdoing. The police then use a deceptive tactic, and tell Joe that his girlfriend (whose identity is still actually unknown to police) is in the other room, explaining the arrangement. Joe is not convinced, remembering that the officers had earlier asked him to identify the woman with him in the video, but that he refused. The gunman is never apprehended, but the police arrest Joe for what they believe to be his involvement in the crime. He is charged with robbery (PC 211) and criminal conspiracy (PC 182). Joe posts bail and hires a Los Angeles Criminal Defense Attorney to represent him at LAX courthouse. Joe's defense lawyer reviews the videotape, and the rest of the investigation, appoints a private investigator to question the witnesses and subpoenas other stores' video tapes to look for footage that might help show Joe's innocence. Joe's attorney sets up a meeting with the District Attorney, to show footage from several other stores, where Joe and his girlfriend had been shopping. Joe made purchases in some of the stores, and, over the course of nearly two hours, entered and exited several other stores, none of which were robbed. Additionally, the jewelry store surveillance video appears to show Joe holding the door for his girlfriend right before the gunman runs in. The District Attorney files charges anyway, and Joe's case proceeds to preliminary hearing. At preliminary hearing, with a strong cross-examination of the investigating detective, Joe's lawyer is able to convince the judge that the government lacks evidence of criminal activity and moves to have the charges dismissed. The judge grants the motion and Joe is free to go. He also may petition to have his arrest record sealed. Being arrested or charged with a crime is scary, stressful and embarrassing.
